What a notice must contain
Under 17 U.S.C. § 512(c)(3)(A), a notice of claimed infringement must be in writing and include:
- The physical or electronic signature of a person authorized to act for the owner of the exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to be infringed, or a representative list if one notice covers several works.
- Identification of the material claimed to be infringing and information reasonably sufficient for us to find it. For Spoken Margins, give the full share link.
- Your address, telephone number and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act for the owner of the exclusive right.
Under § 512(f), a person who knowingly misrepresents that material is infringing may be liable for damages.
How we handle share links
The contents of a share link, including the packet and the page’s preview text, are encrypted on the sender’s phone. The key travels only in the link, so our server stores data it cannot read. For that reason we act on a report without reading the content: a reported link is disabled at once, and no person or automated system reviews what it held. Links also expire on their own after a set time.
Because we cannot read the content, we need the full link, including its key, to identify it.
The sender’s app shows a short notice that a link was taken down after a report. It does not name the reporter or the reason. Repeated reports against the same sharer can end that person’s ability to create share links. Material sent directly as a file, by AirDrop, Messages or Files, never passes through our server.
Counter-notice
If you shared a link that was disabled after a copyright notice and you believe it was disabled by mistake or misidentification, you may send a counter-notice to the designated agent above. Under 17 U.S.C. § 512(g)(3), it must include:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled, and where it appeared before removal. Give the link.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled by mistake or misidentification.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the district where your address is (or, if outside the United States, any district where we can be found), and that you will accept service of process from the person who sent the original notice or that person’s agent.
Under § 512(g)(2), we send a copy of a counter-notice to the person who sent the notice.
Report a link
Anyone can report a share link without an account, for copyright or for any other reason. A web form for this is planned. Until it is live, send the full link and your reason to the designated agent’s email above.
